Lambeth Removals Terms and Conditions of Service

These Terms and Conditions set out the basis on which Lambeth Removals provides household and commercial removal, relocation and related services within the United Kingdom. By booking or using our services, you agree to be bound by these Terms and Conditions. You should read them carefully before making a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

1.1 Client means the person, company or organisation that requests, books or pays for the services.

1.2 Services means any removal, relocation, packing, unpacking, loading, unloading, storage handling, disposal of items, or related services provided by Lambeth Removals.

1.3 Goods means the items, belongings, furniture, equipment or other property in respect of which the services are to be provided.

1.4 Contract means the agreement between Lambeth Removals and the Client for the provision of services, incorporating these Terms and Conditions and any written quotation or confirmation issued by us.

1.5 Working Day means any day other than a Saturday, Sunday or public holiday in England and Wales.

2. Scope of Services

2.1 Lambeth Removals provides domestic and commercial removal services, including local and regional moves, packing and unpacking, and associated services, subject to these Terms and Conditions.

2.2 Any additional services requested by the Client that are not expressly set out in the quotation or booking confirmation may be subject to separate charges and will only be carried out if agreed by Lambeth Removals.

2.3 We reserve the right to refuse to handle or transport any Goods that, in our reasonable opinion, are unsafe, illegal, inadequately packed, excessively fragile, environmentally hazardous or otherwise unsuitable for removal.

3. Booking Process

3.1 All bookings must be made directly with Lambeth Removals through our designated booking channels. A booking is not confirmed until it has been accepted by us and you have received a written confirmation or quotation acceptance from us.

3.2 When making a booking, you must provide accurate and complete information, including but not limited to the collection and delivery addresses, access details, property type, number and nature of Goods, and any special requirements.

3.3 Quotations are based on the information provided by the Client. If the information is incomplete or inaccurate, Lambeth Removals reserves the right to amend the quotation, apply additional charges or cancel the booking.

3.4 Quotations are normally valid for a limited period as stated in the quotation. If no period is stated, the quotation is valid for 30 days from the date of issue, unless withdrawn earlier by Lambeth Removals.

3.5 The Contract is formed when the Client accepts the quotation or booking proposal, and Lambeth Removals confirms the booking in writing, which may include electronic confirmation.

4. Client Responsibilities

4.1 The Client is responsible for:

a. Ensuring that all Goods to be moved are properly packed, labelled and ready for collection, unless packing services have been expressly included in the Contract.

b. Obtaining all necessary permissions, permits, parking suspensions, and access arrangements at both collection and delivery addresses.

c. Ensuring that there is adequate and safe access for our vehicles and staff to the properties involved.

d. Being present or represented at the collection and delivery locations to direct operations and confirm that the services have been carried out.

e. Securing valuable documents, money, jewellery, precious metals, and other high-value items, which must not be included in the Goods for removal unless expressly agreed.

4.2 The Client warrants that he or she is the owner of the Goods or is authorised by the owner to enter into the Contract and to arrange for the services to be provided in respect of the Goods.

5. Payments and Charges

5.1 Charges for our services will be as set out in the quotation or as otherwise agreed in writing. Unless otherwise stated, all charges are exclusive of any applicable VAT or other taxes, which will be added at the prevailing rate.

5.2 Lambeth Removals may require a deposit or full prepayment to secure the booking. Any required deposit or prepayment will be stated in the quotation or booking confirmation.

5.3 Unless otherwise agreed in writing, all outstanding balances are payable on or before completion of the services. We reserve the right to withhold delivery or cease work if payment is not made when due.

5.4 Payments must be made using the methods accepted by Lambeth Removals. We are under no obligation to accept any particular form of payment.

5.5 If the actual work undertaken differs from what was quoted due to inaccurate information, additional Goods, delays caused by the Client, restricted access or other unforeseen circumstances beyond our control, we may apply additional charges at our prevailing rates.

5.6 If the Client fails to pay any sum when due, Lambeth Removals may charge interest on the unpaid amount at the statutory rate from the due date until payment is received in full, and may recover from the Client all costs incurred in collecting the overdue amount.

6. Cancellations and Amendments

6.1 The Client may cancel or amend a booking by giving notice to Lambeth Removals in writing.

6.2 If the Client cancels more than 7 Working Days before the scheduled service date, any deposit paid may be refunded, subject to any reasonable administration costs.

6.3 If the Client cancels within 7 Working Days but more than 2 Working Days before the scheduled service date, Lambeth Removals reserves the right to retain part or all of the deposit or require payment of up to 50 per cent of the quoted charges to cover lost time and costs.

6.4 If the Client cancels within 2 Working Days of the scheduled service date, fails to be available, or fails to provide access for the services to be carried out, Lambeth Removals may charge up to 100 per cent of the quoted charges.

6.5 Any amendments to bookings, including changes to dates, times, addresses or scope of services, are subject to availability and may incur additional charges.

6.6 Lambeth Removals reserves the right to cancel or postpone services due to circumstances beyond our reasonable control, including but not limited to severe weather, vehicle breakdowns, staff illness, accidents, or other events of force majeure. In such cases, we will seek to agree an alternative date with the Client. Our liability in such cases will be limited to a refund of any amounts paid for services not provided.

7. Access, Parking and Delays

7.1 The Client is responsible for ensuring that there is safe and adequate access to the collection and delivery points, including any necessary parking arrangements for our vehicles.

7.2 Any parking charges, fines or penalties incurred as a result of inadequate arrangements or incorrect information provided by the Client may be charged to the Client.

7.3 If our staff or vehicles are delayed at the collection or delivery address due to factors within the Client's control, Lambeth Removals may apply waiting time charges at our standard hourly rates.

8. Goods Not Accepted for Removal

8.1 Unless otherwise agreed in writing, Lambeth Removals will not accept for removal or handling any of the following:

a. Money, securities, jewellery, watches, precious metals or stones.

b. Important documents such as passports, deeds, financial papers or valuable collections.

c. Perishable goods, plants or animals.

d. Explosive, flammable, corrosive, toxic or hazardous materials, including gas bottles, paints, solvents, chemicals and similar substances.

e. Illegal goods or items not lawfully in the possession of the Client.

8.2 If such items are included in the Goods without our knowledge, we shall have no liability for any loss, damage, deterioration or consequences arising from their presence, and the Client will indemnify Lambeth Removals against any claims, damages, costs or expenses arising as a result.

9. Liability and Insurance

9.1 Lambeth Removals will exercise reasonable care and skill in providing the services. Our liability for loss of or damage to Goods or property is subject to the limitations set out in this section.

9.2 Our liability for loss or damage to Goods, howsoever caused, shall be limited to a reasonable cost of repair or replacement, taking into account fair wear and tear and the age and condition of the Goods, and shall not exceed a maximum aggregate amount per Contract as specified in the quotation or in any applicable insurance cover.

9.3 We shall not be liable for:

a. Loss or damage arising from inherent defects, characteristics or fragility of the Goods, including but not limited to assembled flat-pack furniture, veneers, and items not designed to be moved once assembled.

b. Cosmetic or minor damage such as scratches, scuffs or dents that are consistent with normal handling and movement.

c. Loss or damage caused by failure of the Client to adequately pack, protect or secure Goods, where we have not provided packing services.

d. Loss or damage to Goods packed or unpacked by the Client or a third party.

e. Loss of consequential or indirect nature, including loss of use, loss of profits or emotional distress.

9.4 The Client must notify Lambeth Removals in writing of any loss or damage as soon as reasonably practicable and in any event within 7 days of completion of the services. We may decline to consider claims made outside this period.

9.5 Where insurance cover is available and has been arranged, any claim will be subject to the terms, conditions and exclusions of the relevant policy. The Client may be required to provide evidence of value and ownership.

9.6 Nothing in these Terms and Conditions shall limit or exclude Lambeth Removals' liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability which cannot be excluded or limited under applicable law.

10. Waste Regulations and Disposal of Items

10.1 Lambeth Removals operates in accordance with applicable UK waste management and environmental regulations when handling and disposing of unwanted items.

10.2 Where services include removal of waste or unwanted items, the Client confirms that such items are lawful to dispose of and that they are the owner or have authority from the owner to arrange disposal.

10.3 We will not remove or dispose of hazardous, clinical, chemical or controlled waste. The Client is responsible for ensuring such materials are dealt with through appropriate licensed channels.

10.4 Items designated for disposal may be taken to licensed waste transfer stations, recycling centres or other lawful facilities. Once collected for disposal, such items will not be returned to the Client.

10.5 The Client agrees to indemnify Lambeth Removals against any fines, penalties, costs, claims or expenses arising from the presence of prohibited or unlawful items in waste or disposals collected from the Client, where we were not made aware of their nature.

11. Storage and Holding of Goods

11.1 If, as part of the services, Goods are to be temporarily held or stored by Lambeth Removals or at facilities arranged by us, such storage will be subject to separate storage terms and may attract additional charges.

11.2 The Client must ensure that all Goods intended for storage are properly packed and suitable for the period of storage. We accept no liability for deterioration arising from the inherent nature of stored Goods.

12. Complaints and Dispute Resolution

12.1 If the Client is dissatisfied with any aspect of the services, they should raise the issue with Lambeth Removals as soon as possible so that we have an opportunity to address the matter.

12.2 We will use reasonable endeavours to investigate and resolve complaints promptly and fairly. The Client agrees to cooperate with any investigation and provide any relevant information we reasonably request.

12.3 If a dispute cannot be resolved amicably, the parties may consider independent mediation or other forms of alternative dispute resolution before commencing court proceedings, although this is not a requirement.

13. Data Protection and Privacy

13.1 Lambeth Removals will collect and process personal data relating to the Client and, where applicable, their representatives for the purposes of administering bookings, providing services, processing payments and meeting legal obligations.

13.2 Personal data will be handled in accordance with applicable UK data protection legislation. We will take reasonable steps to keep personal data secure and to prevent unauthorised access or disclosure.

14. General Provisions

14.1 Lambeth Removals may update or amend these Terms and Conditions from time to time. The version in force at the time of booking will apply to the Contract.

14.2 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be treated as deleted, but the remaining provisions shall continue in full force and effect.

14.3 No failure or delay by Lambeth Removals in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.

14.4 The Client may not assign or transfer any of their rights or obligations under the Contract without our prior written consent. Lambeth Removals may assign or subcontract its rights and obligations provided that the level of service to the Client is not materially affected.

14.5 Nothing in these Terms and Conditions is intended to confer any rights on any third party, whether under the Contracts Rights of Third Parties Act 1999 or otherwise.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation including non-contractual disputes or claims, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with the Contract or its subject matter or formation.
